New Delhi: The Supreme Court on Wednesday granted an interim bail to the 23 -year -old influencer accused of raping a 40 -year -old woman, despite being in jail for 9 months, allegations have not been framed against her and the court said that the victim is “not a child” and “” No hand claps “.

A bench of Justice BV Nagratna and Justice Satish Chandra Sharma made a sharp remarks, asking how the Delhi Police could file a case of rape against the social media influencer youth, while the woman voluntarily went with her. The bench said, “There is no clap with one hand. On what basis you (Delhi Police) have registered a case under Section 376 of the IPC. She is not a child. Is a 40 -year -old woman. They both went to Jammu together. Why have you imposed Section 376. This woman goes to Jammu seven times and husband has no objection? ”

The apex court said that this is a suitable case to grant interim bail as the accused has been in jail for 9 months and the charges have not been framed. The court directed that the accused should be produced in the subordinate court and interim bail should be granted under the rules and rules. The bench said that he would not misuse his freedom and would not try to contact the woman. The apex court also commented on the accused and asked, “Who is affected by such people?”

What is the whole matter?

The Supreme Court was hearing a petition filed by the accused youth against an order from the Delhi High Court. The High Court refused to grant him bail due to the seriousness of the allegations. According to the police complaint, the woman first came into contact with the accused through social media in 2021 when she was looking for a social media influencer to promote her clothes brand.

Woman gives iPhone to Influencer

During the initial conversation, the accused allegedly requested an iPhone to make the promotional material effective, which he made available through an authorized ‘Apple Store’ in Jammu. However, his professional relations deteriorated after the accused tried to sell the iPhone. The authorized seller returned the money to the woman’s account after deducting Rs 20,000. The complaint stated that although the accused had promised to return the money, the woman decided to end all the relationship with her.

‘The young man raped and raped, took pornographic pictures’

The youth went to the woman’s house in Noida to return Rs 20,000 in December 2021 and apologize. He then persuaded the woman to travel to shoot a promotional material in Connaught Place. During the yatra, the accused allegedly gave her a dessert and she fainted. The accused asked him to take him to Hindu Rao Hospital but he allegedly took the woman to a deserted area behind the hospital and sexually assaulted her, stole money from her purse and took pornographic pictures of her.

Influencers kept taking blackmail to Jammu- woman

According to the complaint, the woman was then allegedly forced to go to Jammu, where she was sexually abused, forced and threatened her continuously during a period of two and a half years. In this case, FIR was registered under Section 376 (rape) of the Indian Penal Code, 354 (attack on women), 323 (deliberately hurt), 506 (criminal intimidation), 509 (women’s dignity) and 34.
