New Delhi: On Tuesday, the Supreme Court refused to give a relaxation of surrender to a convict in the case of murder of wife for dowry, saying that participating in Operation Sindoor does not give you a permission to atrocities at home. On Tuesday, a bench of Justice Ujjal Bhuiyan and Vinod Chandran of Justice made this remark while hearing an appeal filed against an order from the Punjab and Haryana High Court.
What else did the Supreme Court say?
The High Court rejected the person’s appeal and upheld his sentence. The apex court initially expressed reluctance in exempting the person. Senior advocate Vikram Chaudhary, appearing for the petitioner, said that the person had participated in Operation Sindoor. He said, “For the last 20 years I have been posted as Black Cat Commandos in Rashtriya Rifles.” Then the bench said, “This does not allow you to atrocities at home. This shows how fit you are physically, and how you could kill your wife alone, strangled your wife. ”
‘This is not a matter of discount’
The bench said that the petitioner was convicted for a serious offense, so this is not a suitable case to give him a discount. However, the apex court issued a notice in the case and sought a response from the defendants in 6 weeks.
What is the whole matter?
In July 2004, a lower court in Amritsar convicted the petitioner Baljinder Singh under Section 304-B (dowry murder) of the Indian Penal Code (IPC) for the death of his wife within two years of his marriage. Police alleged that the woman faced harassment and cruelty in her in -laws for dowry.
‘Husband and father -in -law strangled with sardine’
Eyewitnesses, including the deceased’s brother and his wife, said that when they reached her in-laws at 9 am on July 18, 2002, she saw her husband and father-in-law strangled her with Chunni, while her mother-in-law and sister-in-law had held her hands and feet. The family alleged that when they made a noise, all the accused fled and but died on the spot.
